CSMS # 61248079 – GUIDANCE: Revocation of 12 Section 232 General Approved Exclusions The purpose of this memorandum is to provide guidance on the Department of Commerce, Bureau of Industry and Security, May 20, 2024, final rule revoking 12 previously granted Section 232 General Approved Exclusions (GAEs). BACKGROUND On May 20, 2024, Department of Commerce, Bureau of Industry and Security, issued Federal Register Notice (FRN) 89 FR 43740, revoking 12 General Approved Exclusions (GAEs), consisting of six GAEs for steel and six GAEs for aluminum. The revocations are effective July 1, 2024.The functionality for the acceptance of the updated GAEs will be available in the Automated Commercial Environment (ACE) as of 7:00 a.m. ET, June 27, 2024. GUIDANCE Effective July 1, 2024, FRN 89 FR 43740 revoked 12 GAEs, six GAEs for steel and six GAEs for aluminum. For imports from countries subject to Section 232 duties on steel and aluminum articles under the applicable Chapter 72, 73, or 76 HTS classification, importers must reference the GAE identifier which is a 10-digit HTS classification into the ACE system that corresponds to the steel or aluminum articles being imported. Do not file the Section 232 Chapter 99 HTS classification for the Section 232 duties. For imports from countries subject to Section 232 quotas, a Chapter 99 HTS is required, consult the quota bulletin for the respective Chapter 99 HTS and applicable country of origin at Quota Bulletins | U.S. Customs and Border Protection (cbp.gov) for the GAE filing requirements.
