PURPOSE:
On Thursday, August 24, 2023, the Port Authority of New York and New Jersey provided notice to Red Hook Container Terminal that Piers 9A and 9B must be vacated due to safety concerns by September 26, 2023. The purpose of this pipeline is to update the trade community of the immediate impact to the Port of New York/Newark’s examination process at Red Hook Container Terminal located at 70 Hamilton Ave, Brooklyn, NY caused by this action. This forced relocation nullifies the “Memorandum Of Understanding Between United States Customs and Border Protection, The Port Authority of New York and New Jersey and Red Hook Container Terminal, LLC” signed on July 25, 2019 because the location contemplated by that MOU is no longer available for use.

BACKGROUND:
In 2012, U.S. Customs and Border Protection (CBP) designated Pier 9 as a location where cargo examinations may be conducted pursuant to 19 CFR 151.6 & 151.7. Based on this, CBP entered into an agreement with the Port Authority of New York and New Jersey and Red Hook Container Terminal for the examination of cargo at 70 Hamilton Ave, Brooklyn, NY. The MOU has been renewed twice since 2012.

ACTION:
The decision by the Port Authority of New York and New Jersey to declare Pier 9A and 9B as unsafe forces Red Hook Container Terminal to vacate the building by September 26, 2023, and in turn effectively terminates CBP’s ability to conduct examinations at that location. Red Hook Container Terminal has proposed utilizing space at Pier 8 located at 2 Atlantic Avenue Brooklyn, NY as an interim or replacement site for examinations. CBP is working closely with Red Hook
