BREAKING NEWS: USTR Releases Final Version of List 4

The USTR posted the following notice on its website earlier this morning regarding the final version of List 4 of the Section 301 China tariffs:

Key points are as follows:

  • The additional tariff will be 10 percent.
  • A number of tariff codes from the proposed version of List 4 have been removed. The USTR cited health, safety, national security and “other factors” as reasons for removing these tariffs.  Tariff codes removed from the final list will not be subject to the additional 10 percent.
  •   List 4 is comprised of two sub-lists: List 4A and List 4B.  Tariffs listed on List 4A are effective September 1, 2019.  Tariffs listed on 4B are effective December 15, 2019.  USTR did not indicate whether the effective dates are based on date of arrival, date of entry, etc.  This issue should be clarified in the next few days and we will pass along further information upon receipt.

There will be an exclusion process; however, the USTR did not provide any information regarding its particulars.  We will pass this information along as well once issued.
